Former Kwale County electoral boss has been arrested by the Ethics and Anti- Corruption Commission (EACC)over alleged corruption offences related to procurements amounting to over Ksh. 14.89million during the 2017 General Elections in Kinango Constituency.
Said Mtili Kajambo, the former Kwale County Independent Electoral Boundaries Commission (IEBC) Deputy Elections Manager, was arrested yesterday over alleged “fraudulent acquisition of public property”, “Conflict of Interest” among other crimes.
Confirming the arrest, EACC Head of Corporate Communication, Philip Kagucia said that Said would be prosecuted following recommendations from the Office of the Director of Public Prosecutions.
Mr. Said appeared before Chief Magistrate Edna Nyaroti of the Mombasa Anti-Corruption Court this morning where he took plea and was released on a Kenya shillings One (1) million bail or a Kshs. 300, 000 cash bail.
The former IEBC chief is accused of offences in contravention of the Anti-Corruption and Economic Crime Act (ACECA 2003), Public Procurement and Asset Disposal Act (2015) and the Penal Code (Cap. 63, Laws of Kenya).
The alleged offenses include Fraudulent Acquisition of Public Property contrary to Section45(1) (a) as read with Section 48 of ACECA, and Conflict of Interest contrary to Section 42(3) as read with section 48 of the Anti- Corruption and Economic Crimes Act, 2003.
Other charges include fraudulent practice in Procurement Proceedings Contrary to Section 176(1)(i) as read with section 176(2) of the Public Procurement & Asset Disposal Act, 2015, Forgery and Uttering false documents contrary to Section 349 and 351 of Penal code.
The alleged offences were committed in FY 2017/2018.
